{"id":55431,"date":"2022-05-04T11:33:13","date_gmt":"2022-05-04T09:33:13","guid":{"rendered":"https:\/\/www.lalainieredewazemmes.com\/?page_id=55431"},"modified":"2026-03-17T17:59:45","modified_gmt":"2026-03-17T16:59:45","slug":"termsofservice","status":"publish","type":"page","link":"https:\/\/www.lalainieredewazemmes.com\/en\/termsofservice\/","title":{"rendered":"Terms of Service"},"content":{"rendered":"<h2 style=\"text-align: center;\"><span style=\"color: #23336c;\">Terms of Service<\/span><\/h2>\n<p style=\"text-align: justify;\">This document entitled Terms of Service defines the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the www.lalainieredewazemmes.com website, hereinafter referred to as \u2018the customer\u2019, on the one hand, and the company La Laini\u00e8re de Wazemmes, whose registered office is located at 7 rue Jules Guesde, 59000 Lille, France, registered in the Lille Trade and Companies Register under number 504 045 030 00013, a SAS with capital of \u20ac10,000, whose intra-community VAT number is FR 65504045030, hereinafter referred to as www.lalainieredewazemmes.com or La Laini\u00e8re de Wazemmes.<\/p>\n<p style=\"text-align: justify;\">Any acceptance of the clause \u2018I have read the general conditions of sale and the cancellation conditions and I adhere to them unreservedly\u2019 implies the buyer&#8217;s unreserved adherence to these general terms and conditions of sale and service.<\/p>\n<h3><span style=\"color: #d7b38f;\">1. Price<\/span><\/h3>\n<p style=\"text-align: justify;\">All product prices are quoted in euros (\u20ac), inclusive of tax (VAT) and exclusive of delivery charges. Consequently, transport costs are applicable on the day the order is placed. La Laini\u00e8re de Wazemmes reserves the right to modify its prices at any time without prior notice. Products will be invoiced on the basis of the rates in force at the time orders are registered. The products remain the property of www.lalainieredewazemmes.com until full payment of the total amount of the products ordered has been received by www.lalainieredewazemmes.com. The amount of an order is payable in full and in a single instalment.<\/p>\n<h3><span style=\"color: #d7b38f;\">2. Order<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Customer journey<\/span> : the customer chooses a product and then adds it to the shopping basket. Once they have completed these actions, they will be redirected to the shopping basket. On the basket page, they can change the quantity or delete a product. They can also add a comment about their order and add a promotional code if they have one. They will then be asked to enter their personal details and fill in the delivery and billing address fields, choose the delivery method and pay the total amount of the order (including delivery costs).<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Order<\/span> : www.lalainieredewazemmes.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who, in its opinion, presents any form of risk. Any order implies acceptance of the prices and descriptions of the products available for sale. La Laini\u00e8re de Wazemmes undertakes to honour orders received on its website www.lalainieredewazemmes.com only if payment of the total amount has been received and within the limits of available stocks of products. <\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Availability product<\/span> : if one or more products ordered are not available, www.lalainieredewazemmes.com undertakes to inform the customer as soon as possible using the contact details provided by the customer when placing the order (e-mail or telephone). La Laini\u00e8re de Wazemmes will then offer the customer to remove the missing product from the order (the customer will receive a credit note or a refund of the amount of the product) or to replace the missing product with another reference in stock. If none of these options are chosen by the customer, then the customer&#8217;s order will be cancelled in its entirety and the corresponding total amount will be refunded (including delivery costs). The customer will also have the option of waiting for the missing products to return to stock after delivery from La Laini\u00e8re de Wazemmes&#8217; suppliers. If the customer chooses to wait, La Laini\u00e8re de Wazemmes undertakes to order the missing products from the supplier(s) as soon as possible and to send the order to the customer as soon as the products are available.The photos of the products on the www.lalainieredewazemmes.com website are not contractual, certain details such as the colour or patterns may vary depending on the different screens in particular. Some products may also be part of an assortment.<\/span><\/li>\n<\/ul>\n<h3><span style=\"color: #d7b38f;\">3. Payment<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Products are payable outright during the effective order. The customer can choose among 6 payment solutions : credit card (Visa, MasterCard, Debit Card), PayPal, Apple Pay, Google Pay, bank transfer or cheque.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Paypal<\/span>\u00a0: Paypal(Europe) LLC ans Co., is a luxembourgish joint-stock company, registered into the Trade and Companies Register of Luxembourg under the number B118349, whose head office is located sis 22-24, Boulevard Royal \u2013 L-2449 Luxembourg. For any information, the Customer can consult the following website\u00a0:<\/span><a href=\"https:\/\/www.paypal.com\/\"> <span style=\"font-weight: 400;\">https:\/\/www.paypal.com<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li aria-level=\"1\"><span style=\"text-decoration: underline;\">Apple Pay<\/span> : payment solution managed via PayPal (refer to the information above).<\/li>\n<li aria-level=\"1\"><span style=\"text-decoration: underline;\">Google Pay<\/span> : payment solution managed via PayPal (refer to the information above).<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Credit card<\/span> : solution Monetico. Monetico Payment commits to apply the dispositions from Law 78-17 of 1978 6th January related to &#8220;IT, to files and to liberties&#8221;. Monetico \u2013 Cr\u00e9dit Industriel et Commercial (CIC). Bank ruled by the articles L.511-1 and following from the French Monetary and Financial Code. When he chooses this payment method, he will have the possibility to download the bank details via an informative pop-up. He will receive an order confirmation mail in which, again, there will be the bank information to make the transfer. Once the bank transfer received on the bank account of<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">www.lalainieredewazemmes.com<\/span><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">www.lalainieredewazemmes.com<\/span><span style=\"font-weight: 400;\"> will proceed to the preparation and delivery progression of the order. \u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Cheque<\/span> : the customer has a 7-days-period to send the cheque by a Post service to the order of La Laini\u00e8re de Wazemmes. The address to send to is : 7 rue Jules Guesde, 59 000 Lille, FRANCE. He will receive an order confirmation mail in which, again, will be mentionned the payment information to make the payment. Once the cheque received, <\/span><span style=\"font-weight: 400;\">www.lalainieredewazemmes.com<\/span><span style=\"font-weight: 400;\"> will proceed to the preparation and delivery progression of the order.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Data verification\u00a0:\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">www.lalainieredewazemmes.com reserves the right to verify the personal data communicated by the customer and to adopt any measures considered necessary to the verification of the fact that the person whose bank account is debited is actually the one\u2019s who made the order, this to avoid any fraudulent payment. This verification can take the form of requests of evidence of identity\/address\/bank documents(bank details or cancelled cheque). The absence of answer from the customer to this type of request in a 2-days-period following the formed request by www.lalainieredewazemmes.com will automatically lead to the cancellation of the concerned order, and this without any possibility of later complaint. www.lalainieredewazemmes.com will also have any liberty to proceed to the direct cancellation of an order which would present one or many risk factors of fraudulent uses of bank card. www.lalainieredewazemmes.com uses every mean to ensure the confidentiality and safety of data transmitted on the web and on the website www.lalainieredewazemmes.com. To this end, the website uses a securised module of payment type SSL (Secure Socket Layer).<\/span><\/p>\n<h3><span style=\"color: #d7b38f;\">4. Shipment and delivery<\/span><\/h3>\n<p>All orders placed on the www.lalainieredewazemmes.com website before 2pm Monday to Friday (excluding weekends and public holidays) will be prepared and dispatched the same day (subject to validation of payment, possible stock problems and availability of preparation teams).<\/p>\n<p>Any customs clearance costs are not covered by www.lalainieredewazemmes.com and are therefore the responsibility of the customer.<\/p>\n<p>La Laini\u00e8re de Wazemmes offers 3 delivery methods:<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>La Poste Colissimo home delivery<\/strong> (no signature required):\n<p>For delivery to <strong><span style=\"text-decoration: underline;\">mainland France (including Corsica)<\/span> as well as <span style=\"text-decoration: underline;\">Monaco and Andorra<\/span><\/strong>, La Laini\u00e8re de Wazemmes offers home delivery using the services of La Poste Colissimo. The delivery costs, payable by the customer, for this home delivery method are \u20ac3.99 including tax if the parcel weighs less than 200g and \u20ac8.99 including tax if the parcel weighs more than 200g. The weight of the parcel is automatically determined by the weight of the items ordered. This method of home delivery, to mainland France only (excluding Corsica, Monaco, and Andorra), guarantees the customer delivery within 2 working days (excluding weekends and public holidays) after collection of the parcel from our warehouse in Lille. Exceptionally, the parcel may be delivered within 3 working days (excluding weekends and public holidays) in the event of problems with our services or those of La Poste. As a precautionary measure, and to include the time taken by our team to prepare orders, La Laini\u00e8re de Wazemmes indicates a home delivery time of 2 to 3 working days (excluding weekends and public holidays). For Corsica, Monaco, and Andorra, please allow an additional 1 to 2 business days beyond the delivery times indicated for mainland France.For delivery to one of the <strong><span style=\"text-decoration: underline;\">other countries in the Europe zone<\/span><\/strong> listed below (Cyprus, Germany, Austria, Belgium, Bulgaria, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Czech Republic, Slovakia, Slovenia, Sweden), home delivery is also available via the services of La Poste Colissimo. Delivery costs are \u20ac11.99 including VAT and are payable by the customer. La Laini\u00e8re de Wazemmes does not give a precise delivery time for the countries in the Europe zone mentioned above, as this time will vary depending on the shipping country selected by the customer.<\/p>\n<p>For all delivery zones, the parcel will be delivered in a letterbox to the customer&#8217;s home without the customer&#8217;s signature (with the exception of certain countries which do not authorise delivery without a signature, such as Spain or Germany for example). If the customer is not at home and\/or the parcel does not fit in the letterbox, La Poste will contact the customer in order to re-schedule the parcel for delivery on another day or to drop off the parcel at a post office close to the customer&#8217;s address.<\/p>\n<p>For all home delivery zones (France and Europe), the customer will be informed by automatic email of the progress of the delivery of their parcel and a parcel tracking number will be sent to them. The customer will be able to access the parcel tracking directly on the La Poste website via the following link: <a href=\"https:\/\/www.laposte.fr\/outils\/suivre-vos-envois\">www.laposte.fr\/outils\/suivre-vos-envois<\/a><\/li>\n<li style=\"text-align: justify;\"><strong><strong>La Poste Colissimo pick-up points :<\/strong><\/strong>For delivery to <strong><span style=\"text-decoration: underline;\">mainland France (including Corsica) as well as Monaco and Andorra<\/span><\/strong>, La Laini\u00e8re de Wazemmes offers delivery to a collection point near you using the services of La Poste Colissimo. Postage costs for this method of delivery to a collection point are \u20ac6.99 including VAT and are payable by the customer. <strong>Delivery is free for all orders with a total value of \u20ac55 or more, including VAT<\/strong>. Delivery times vary from 3 to 6 days after collection of the parcel by La Poste from our warehouse in Lille.\n<p>For delivery to <span style=\"text-decoration: underline;\"><strong>Belgium<\/strong><\/span>, delivery to a collection point is also available via La Poste Colissimo. Delivery costs are \u20ac8.99 including VAT and are payable by the customer. <strong>Delivery is free for all orders with a total value of \u20ac100 or more, including VAT.<\/strong> For deliveries to other European countries (excluding France and Belgium), delivery to a collection point is not available.<\/p>\n<p>For all shipping zones eligible for delivery at a collection point, the customer will be informed by automatic email of the progress of the delivery of their parcel and a parcel tracking number will then be sent to them. The customer will be able to access the parcel tracking directly on the La Poste website via the following link: <a href=\"http:\/\/www.laposte.fr\/outils\/suivre-vos-envois\">www.laposte.fr\/outils\/suivre-vos-envois<\/a><br \/>\n<strong><br \/>\n<\/strong><\/li>\n<li><strong><strong>Click and Collect in shop in Lille:<\/strong><\/strong>www.lalainieredewazemmes.com also offers customers the \u2018Click and Collect\u2019 option so that they can collect their parcel themselves, once it has been prepared, from the following address:\n<p style=\"text-align: justify;\"><strong>La Laini\u00e8re de Wazemmes <\/strong><br \/>\n<strong>7 rue Jules Guesde<\/strong><br \/>\n<strong>59000 Lille<\/strong><\/p>\n<p>This method of delivery does not incur any additional costs. Following the first order validation email, the customer will receive a second email within 1 to 2 working days maximum (excluding weekends and public holidays) indicating that the order is ready to be collected from the Lille shop at the address given above. Only this second confirmation email validates the completed preparation of the order. Customers are therefore asked not to go to the shop to collect their parcel until their order has reached \u2018completed\u2019 status. Order status is also accessible and verifiable on the www.lalainieredewazemmes.com website from the \u2018my account\u2019 &gt; \u2018orders\u2019 area.<\/p>\n<p>Finally, to collect their parcel, customers must take their order number or the order confirmation e-mail with them to the shop reception desk. If the customer wishes to have their parcel collected by a third party, they must provide the third party with their order number and the name used to place the order.<strong><br \/>\n<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Possible problems with delivery<\/span>:<\/p>\n<p style=\"text-align: justify;\">&gt; Incomplete or non-conforming delivery (due to the carrier): the parcel may be damaged or its contents may have been partially or totally stolen. If you find this to be the case, please note it on the carrier&#8217;s delivery note and refuse the parcel.<br \/>\n&gt; Lost parcel: if a parcel is lost by the carrier, please inform us as soon as possible. The company will make enquiries with the relevant departments.<br \/>\n&gt; Incomplete or non-conforming delivery (due to the company): despite the care taken in preparing orders, a product may be missing or an error may have occurred during preparation. If you notice such an error, please notify us as soon as possible by telephone on 03 20 51 39 98 or by e-mail at lainieredewazemmes@gmail.com.<br \/>\n&gt; Defective product in delivery: in the event of a proven defect in an item received, www.lalainieredewazemmes.com undertakes to refund the item once the defect has been identified. In order to assess the defect, and depending on its extent, www.lalainieredewazemmes.com may ask the customer to return the item or to send a photo if it considers this to be useful or essential for the correct assessment of the defect.<\/p>\n<p><span style=\"text-decoration: underline;\">Procedure for declaring an order not received<\/span>:<\/p>\n<p style=\"text-align: justify;\">Any order not received must be declared by the customer by email to lainieredewazemmes@gmail.com or commandes@lalainieredewazemmes.com within a maximum of 14 working days from the date on which the maximum delivery time indicated by the carrier La Poste Colissimo was exceeded. Upon receipt of the e-mail stating that the order has not been received, www.lalainieredewazemmes.com will investigate with the carrier concerned in order to find out more about the delivery status of the parcel that has not been received.<\/p>\n<p>If, at the end of the investigation, the package is declared lost by the carrier La Poste, La Laini\u00e8re de Wazemmes undertakes to offer the customer compensation in the form of a new shipment of the order, a refund or a credit note.<\/p>\n<p>La Laini\u00e8re de Wazemmes declines all responsibility in the event of an error in the delivery address given by the customer when placing the order. If such an error was made by the customer and led to the non-delivery of the parcel by the carrier&#8217;s services, La Laini\u00e8re de Wazemmes will not be able to offer the customer any compensation.<\/p>\n<h3><span style=\"color: #d7b38f;\">5. Securised payment and fight against fraud with bank card<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Payment online by card is securised via 3D Secure Protocol. This latest new protocol enables\u00a0; more than having a crypted connexion from bank to bank\u00a0; to check if your card is actually used by you. If your bank implemented it, a new window will appear on your browser, after the entry of your payment to ask you additional information such as a code which will be sent by message ( or other verifications depending on the customer\u2019s bank). If you don\u2019t complete this information, your payment will not be able to be taken into account and your order will not be able to be sent. In order to ensure the security of the payments, the website www.lalainieredewazemmes.com uses the securised payment service from our bank partner CIC- Monetico. This service includes the SSL safety norm. The confidential data are directly transmitted crypted on the bank server without transiting on physical supports of our internal server. Each payment by card adresses an authorization request to the bank card network. The administrator of the electroic payment delivers an electronic certificate which will worth as an evidence of the sum and date of the transaction in accordance to the dispositions of articles 1316 and following of the civil code.<\/span><\/p>\n<h3><span style=\"color: #d7b38f;\">6. Return, reimbursement and exchange<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Terms and conditions for product returns<\/span> :<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If despite all the efforts of the company La Laini\u00e8re de Wazemmes, the customer is not satisfied with his purchase, in accordance with article L.121-20 of the French Consumer Code, he has a period of 14 clear days from the date of receipt of the product to return the products ordered which do not suit him. However, La Laini\u00e8re de Wazemmes asks the customer to expressly inform it of their request for a return by e-mail to lainieredewazemmes@gmail.com or commandes@lalainieredewazemmes.com before sending back the parcel or one or more products. Except in exceptional circumstances, the customer will receive a reply to their return request within 1 to 2 working days (excluding weekends and public holidays).<\/p>\n<p style=\"text-align: justify;\">Furthermore, with the exception of defective products or errors in order preparation by the company, certain products are not taken back by La Laini\u00e8re de Wazemmes and therefore cannot be returned by the customer. These products are clearly and visibly indicated on the www.lalainieredewazemmes.com website by the words \u2018This product cannot be returned, exchanged or reimbursed\u2019. This notice appears on the product sheets\/pages of the items concerned by this no-return condition. Products on the www.lalainieredewazemmes.com website bearing this notice cannot therefore be the subject of any compensation procedure such as an exchange, refund or credit note.<\/p>\n<p>If the product that the customer wishes to return is eligible for return and if La Laini\u00e8re de Wazemmes has been informed of the customer&#8217;s wish to return the product, the customer may then send the product back to the company. Postage costs associated with sending a parcel, within the framework of a return for dissatisfaction only, are payable by the customer. La Laini\u00e8re de Wazemmes will pay the return costs if, and only if, the return concerns an order preparation error for which the company is responsible or a product with a defect noted by the company after solicitation by the customer.<\/p>\n<p style=\"text-align: justify;\">In terms of compensation, if all the conditions of eligibility for the return mentioned above are met, La Laini\u00e8re de Wazemmes will then offer the customer a refund or a credit note for the amount of the product(s) concerned by the return.<\/p>\n<p style=\"text-align: justify;\">If the customer chooses a refund, the method of payment of the amount owed by the company will be determined by the method of payment used by the customer when placing the order (e.g. if the customer paid for the order via PayPal, the refund will be sent via PayPal). However, for technical reasons, it is not possible to make a refund to the bank card used for the initial payment. If the customer finds himself in this latter situation, he will be asked to send a bank account number so that the company can make a bank transfer of the amount due.<\/p>\n<p style=\"text-align: justify;\">If the customer chooses the credit solution, this will be sent by email in the form of a promotional code to be entered on the www.lalainieredewazemmes.com website when placing a new order. The amount of the credit note will then be deducted from the total amount of the new order.<\/p>\n<p style=\"text-align: justify;\">The refund or credit note, depending on the solution chosen by the customer, will be issued within 14 days of receipt of the return parcel by La Laini\u00e8re de Wazemmes. Except in special cases identified by the company, the carriage costs paid by the customer when placing their initial order cannot be the subject of a refund or credit note.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Terms and conditions for reimbursement\/advice in the event of a defective product\/error in order preparation<\/span>:<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If, on receipt of their order or when using it for the first time, the customer finds that a product is faulty\/damaged or that an error has been made during the preparation of the order (e.g. an item is missing, the wrong colour, the wrong size), they must notify the company Laini\u00e8re de Wazemmes as soon as possible by e-mail to lainieredewazemmes@gmail.com or commandes@lalainieredewazemmes.com giving all the information required to process the request (order number, precise description of the situation and the problem encountered with the parcel or a product, photos, etc.). Except in exceptional circumstances, the customer will receive a response to their request within 1 to 2 working days (excluding weekends and public holidays). If it considers it useful, La Laini\u00e8re de Wazemmes reserves the right to ask the customer for additional information to prove the situation and\/or the problem reported by the customer (example: photo of the defective product).<\/p>\n<p style=\"text-align: justify;\">If the problem is proven according to the elements and documents sent by the customer, La Laini\u00e8re de Wazemmes will then offer the customer an exchange of the product(s) concerned, a refund or a credit note for the total amount of the parcel (if the problem concerns all the products in the order) or the product concerned (if the problem concerns one product in the order in particular). If, and only if, the problem concerns all the products in the order, the delivery costs paid by the customer when placing the initial order may also be compensated by a refund or credit note.<\/p>\n<p style=\"text-align: justify;\">In certain cases, and in particular when it is a question of an error in order preparation for which the company is responsible, La Laini\u00e8re de Wazemmes reserves the right to ask the customer to return the products concerned by the compensation procedure. La Laini\u00e8re de Wazemmes will then issue and send the customer a returns form so that the customer can return the product(s).
